These Terms are established by Vuncloud and we reserve the right to amend them. By registering, logging in, or using the Service, you agree to these Terms and the then-currentPrivacy Policy; where a separate written agreement exists, that agreement prevails.

1. General Provisions & Scope

1.1 These Terms constitute the complete agreement between you and Vuncloud regarding cloud Mac computing resources and related technical services. Plan descriptions, pricing rules, announcements, and order confirmations are supplementary components of these Terms.

1.2 You confirm that you have full legal capacity or lawful authorization. If acting on behalf of an organization, you warrant authority to bind it.

1.3 We may accept or refuse registrations, orders, and high-risk clients at our discretion. For accepted orders, we may delay or cancel provisioning in cases of fraud, arrears, violations, or force majeure.

1.4 The Privacy Policy forms part of these Terms. Please readPrivacy Policy; in case of conflict, the Privacy Policy governs personal information; these Terms govern fees, service availability, liability, and disputes.

2. Service Description & Orders

2.1 The Service is provided 'as is' and 'as available'. Specifications are for reference and do not constitute performance guarantees unless separately committed in writing.

2.2 Orders are offers; we accept upon confirming payment. We may decline orders with pricing errors, insufficient stock, or compliance issues.

2.3 Where 'order before login' is supported, you must complete account binding within the designated period; otherwise we may withhold provisioning.

2.4 Provisioning depends on stock, region, risk review, and information you provide. We provide no definitive commitment on provisioning time except in writing.

3. Pricing, Payment & Billing Cycle

3.1 Prices are as displayed at order time. We may adjust published prices; adjustments have no retroactive effect on active orders.

3.2 Daily billing is one-time and does not auto-renew. Periodic billing auto-renews unless you disable it. Arrears constitute material breach.

3.3 You must pay through designated channels. Chargebacks and payment abuse may result in permanent transaction refusal.

4. Account & Security

4.1 Your account and all credentials are for your exclusive use at your own risk.

4.2 We may take monitoring and access-control measures for contract performance, security audits, and technical support.

4.3 We may restrict or suspend accounts without prior notice when we suspect unauthorized access, fraud, or violations.

4.4 Password reset processes follow real-time in-console prompts.

5. Acceptable Use & Prohibited Conduct

5.1 You warrant compliance with all applicable laws and must not use resources for illegal or infringing purposes. Prohibited conduct includes:

  • Activities illegal in any relevant jurisdiction or exposing the platform to administrative/criminal liability;
  • Infringing intellectual property, privacy, reputation, or trade secrets, or disseminating illegal information;
  • Unauthorized intrusion, scanning, mining, spamming, network abuse, and third-party attacks;
  • Abusing promotions or payment systems through false identities, cash-out, or money laundering.

5.2 Upon finding or suspecting a violation, we may warn, throttle, shut down, terminate service, or permanently suspend accounts.

6. Data, Network & IP

6.1 The legality, authorization, and backup of data within the instance are your responsibility.

6.2 Public network quality and upstream ISP routing are beyond our control.

6.3 IP, bandwidth, and 'dedicated' descriptions are per the product page and orders.

7. Service Changes, Interruptions & Termination

7.1 We may change, replace, or discontinue features or regional supply with reasonable advance notice.

7.2 You may voluntarily unsubscribe per the rules. Consumed periods are non-refundable.

7.3 If we terminate for arrears or breach, we may dispose of resources and recover costs.

8. Refunds, Disclaimers & Limitation of Liability

8.1 Refunds are subject to our published rules. Customized, promotional, or consumed orders may be refused.

8.2 Our aggregate liability shall not exceed the net amount paid in the 12 months preceding the dispute.

8.3 We are exempt from liability for force majeure, government action, or upstream outages.

9. Term Amendments & Notices

9.1 We may amend these Terms at any time. Continued use constitutes acceptance.

9.2 Continuing to use the Service or renewing payment constitutes irrevocable consent to amended Terms.

10. Governing Law & Dispute Resolution

10.1 These Terms are governed by the laws of Vuncloud's registration jurisdiction.

10.2 Disputes shall first be resolved by negotiation; if unsuccessful, submitted to the court at the place of registration.
